Pet Portrait/Commission Terms & Conditions

1. Commission Process

Purchase Your Commission
Select your preferred portrait or commission size, medium, and any optional extras from my shop.

Send Your Reference Images
Reply to your order confirmation email with your reference photos or images.

Order Confirmation
I will contact you to discuss your requirements, confirm the commission details, and provide an estimated completion date.

Scheduling Your Commission
Once all details have been agreed and your commission is accepted, it will be added to my schedule.

Initial Sketch Approval
Work will usually begin within 48 hours. An outline drawing will be created and sent to you for review and approval before painting begins.

Painting Process
After the sketch has been approved, I will begin painting your artwork and provide regular progress updates throughout the process.

Final Approval & Dispatch
Once the artwork is complete, final approval is required before it is carefully packaged and dispatched to you.
2. Reference Images/photographs
The quality of the finished portrait depends greatly on the quality of the photographs provided.
For the best results, please provide:

Clear, high-resolution photographs

Images taken in natural light where possible

Photos that show your pet's eyes clearly

Multiple reference images, if available
If you're unsure whether your photographs are suitable, I'm happy to review them before you book.
Customers must ensure they have permission to use any photographs supplied for commissioned artwork.
By providing photographs, you confirm that:

You own the image or have permission to use it.

The image may be used by me for the purpose of creating the commissioned artwork.
I reserve the right to decline or refuse any pet portrait or commission if the quality of the reference images provided is insufficient to produce artwork to my standards.
3. Payment
Full payment is required at the time of ordering unless otherwise agreed.
No work will commence until payment has been received.
Where instalment payments are agreed, the artwork will not be dispatched until the final balance has been paid in full.
4. Timescales
Turnaround times vary depending on size, complexity, and current workload.
An estimated completion date will be provided when your commission is confirmed.
Please note that completion dates are estimates rather than guarantees.
If you require artwork for a special occasion, please mention this when making your enquiry.
5. Customer Delays
If approval, photographs, or requested information are not provided within 10 days of ordering, the commission may be placed on hold.
Extended delays may result in the commission being rescheduled.
6. Artistic Interpretation
Commissioned artwork is created in my own artistic style.
While every effort will be made to capture the likeness, character, and personality of the subject, artistic interpretation forms part of the creative process.
7. Approval and Amendments
Where proof images or previews are provided, customers should carefully review artwork before approval.
Minor adjustments may be requested during the creation process where appropriate.
Examples include:

Small colour adjustments

Minor background changes

Small compositional refinements
Significant changes requested after work has begun may incur an additional charge.
Once final approval has been given, no further amendments can be made.
8. Shipping and Delivery
Completed artwork will be carefully packaged to help ensure it arrives safely.
Delivery times may vary depending on location and the courier service used.
Customers are responsible for providing accurate delivery information.
Additional postage costs resulting from incorrect information may be charged.
Unless otherwise stated, artwork is supplied unframed.
8.1. Damage During Shipping
Any damage sustained during transit must be reported within 48 hours of delivery and supported by photographs of both the artwork and packaging.
Claims made after this period may not be accepted.
8.2. Lost parcels
In the unlikely event that a parcel is lost in transit, investigations will be conducted with the courier before replacement or refund options are considered.
8.3. Colour Variations
Colours may vary slightly between digital screens and the original artwork due to differences in monitor and device settings.
9. Cancellations
You may cancel your commission before work begins and receive a full refund of any payments made.
Once work has commenced, refunds may be reduced or unavailable depending on the stage reached and the time already invested.
As commissioned artwork is personalised and created specifically for you, completed commissions are generally non-refundable unless faulty or not as described.
10. Copyright and Usage Rights
All artwork, images, designs, text, branding, and content created by Juliana Mitchell-Jones remain the intellectual property of the artist unless otherwise agreed in writing.
The purchase of a commissioned artwork or pet portrait does not transfer copyright ownership to the customer. Copyright and all reproduction rights remain with the artist.
Customers may:

Display the original artwork in their home or private collection

Gift the original artwork to family or friends

Share photographs of the artwork on personal social media accounts, provided appropriate credit is given where possible
Customers may not, without prior written permission:

Reproduce the artwork in any form

Scan, copy, or digitally reproduce the artwork

Create prints or merchandise featuring the artwork

Sell copies of the artwork
-
Create derivative works based on the artwork
-
Use the artwork for advertising, marketing, business, or commercial purposes

License or distribute images of the artwork to third parties
The customer is purchasing the physical artwork only, unless otherwise agreed in writing.
Commercial usage rights, licensing arrangements, and reproduction permissions may be negotiated separately and may incur additional fees.
11. Sharing Artwork
Unless otherwise agreed in writing, I may display photographs or images of completed commissions on my website, portfolio, social media channels, and other promotional materials.
If you would prefer your portrait to remain private, please let me know when booking your commission and I will happily respect your wishes.
12. Website Use
You agree not to:

Use this website unlawfully

Attempt to interfere with website security

Copy or distribute website content without permission

Upload malicious software or code
I reserve the right to restrict access where misuse occurs.
13. Privacy
Your use of this website is also governed by my Privacy Policy.

14. Limitation of Liability
To the maximum extent permitted by law, I shall not be liable for:

Indirect or consequential losses

Delays caused by third-party delivery services

Losses arising from circumstances beyond reasonable control
Nothing in these terms limits liability where it cannot legally be excluded.
15. Force Majeure
I shall not be responsible for delays caused by events beyond my reasonable control, including illness, family emergencies, extreme weather, postal disruption, supplier delays, or other unforeseen circumstances.
16. Changes to These Terms
I reserve the right to update these Terms & Conditions at any time.
Any changes will be published on this page and become effective immediately upon posting.
17. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes arising from these Terms & Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
